Kalshi Faces Contempt Motion as Nevada Alleges Geofencing Failures

Nevada regulators want Kalshi held in contempt after alleging investigators in the state were still able to buy prohibited event contracts despite a court order requiring geofencing.

Nevada regulators are asking a state court to hold Kalshi in contempt. They allege the prediction market operator failed to properly block Nevada users from accessing certain event contracts. For players, the case is another sign that market access can change quickly. It depends on both the location and the state regulators’ response. 

The dispute is centered in Nevada, yet it could matter more broadly. States across the US, including the WV iGaming regulators, are increasingly scrutinizing prediction markets and geofencing controls.

Nevada Says Kalshi Did Not Fully Block Access

The Nevada Gaming Control Board asked the First Judicial District Court for the State of Nevada to hold Kalshi in contempt of court. According to the board’s June 12 filing, Kalshi was required to geofence its operations in Nevada. This was to prevent it from offering sports, election, and entertainment-related event contracts in the state.

A court order dated May 18, 2026, required the geofencing step. The board now alleges Kalshi is “not complying with the court’s preliminary injunction order.”

State investigators were allegedly able to purchase prohibited contracts on Kalshi’s platform eight times across four days: May 28, May 30, May 31, and June 1, 2026. In a press release, Nevada Gaming Control Board Chairman Mike Dreitzer said, 

“The Court has required Kalshi to stop offering covered event contracts in Nevada. We will continue to vigorously enforce Nevada law to safeguard gaming in our state.”

State vs. Federal: The Broader Stakes in the Kalshi Dispute

This case highlights a bigger issue for gambling and event-contract regulation in the US. It focuses on a core question: do state regulators or federal regulators have the final say over these products? 

Kalshi has been in a legal dispute with Nevada for more than a year. The First Judicial District Court granted the board’s request for a temporary restraining order on March 20, 2026. Later, an oral ruling on April 3, 2026, required geolocation and geofencing for Nevada.

The underlying fight goes back even further. The board issued a cease-and-desist notice in early March 2025. That notice ordered Kalshi to stop offering sports event contract markets in Nevada by March 14, 2025. However, KalshiEX LLC filed the lawsuit on March 30, 2025. 

Kalshi argues that Congress gave the Commodity Futures Trading Commission exclusive jurisdiction over futures trading on approved exchanges. In Kalshi’s view, state law cannot intrude on that federal framework.

How This Case Could Affect Players in West Virginia

For the West Virginia market, nothing has changed locally. Prediction market regulations remain unsettled from state to state. A case like this shows how geolocation and geofencing can become critical. This is especially true when a platform’s products fall into a gray area between gambling regulation and federal oversight.

For players, that means availability may depend not just on the platform, but on their resident state at the time of access.

The biggest open question is how the Nevada court will respond to the contempt request, and what penalties it may impose. It is also worth watching Kalshi’s next move. Other states could also follow Nevada’s enforcement approach in the future.
