The Greenbrier has decided to shut down its casino, with the closure set for Friday, according to court documents cited by WSAZ. The report says about 90 casino employees are expected to be laid off, and the closure would also reduce revenue to the state.
WSAZ reported that the shutdown is tied to a refinancing involving former West Virginia Gov. Jim Justice and Kennedy Lewis Investment Management LLC. Justice, his wife Cathy, their son, and several Greenbrier-related entities are named as defendants in a lawsuit filed by White Sulphur Springs Holdings, LLC.
Closure tied to refinancing and ownership approval timeline
According to WSAZ’s report on the court filings, lawyers for Justice said they have been providing information to the West Virginia Lottery for more than two months and have responded to requests for information. They also said the amount needed to complete the refinancing is rising by $145,000 per day because of interest charges.
The West Virginia Lottery had not confirmed when it will consider the Greenbrier’s approval request.
In a letter cited by WSAZ, Acting West Virginia Lottery Director David Bradley said the agency was only notified on Aug. 11 that the casino was at risk of closing because the ownership change had not been approved by Friday, Aug. 7, 2026.
Bradley also said he had told attorneys on July 10 that the Lottery needed time to conduct due diligence and review the required financial documents related to the transaction.

Bradley said it was unlikely the Lottery could finish its review and present the matter to the Lottery Commission before its regularly scheduled Aug. 26, 2026 meeting. That makes the commission’s timing on the ownership request the next key development to watch.
