Rep. Dina Titus has asked House Republican leadership to include her FAIR BET Act in must-pass legislation when the House reconvenes next week, according to a release from Congresswoman Dina Titus.
The measure would restore the federal gambling loss deduction to 100% after a provision in the Senate-amended One Big Beautiful Bill Act reduced it to 90%.
Titus presses for a federal gambling tax fix
In her letter to House Speaker Mike Johnson and Majority Leader Steve Scalise, Titus argued that the deduction change requires gamblers to pay taxes on money they did not earn. She said it unfairly burdens professional gamblers and casual players alike.
“Enactment of this bipartisan provision would correct an unfair change in the tax code and provide needed certainty to taxpayers, businesses, and regulated gaming markets across the country,” Titus wrote.
Titus also warned that the reduced deduction could push players toward offshore and unregulated markets, undermining responsible gaming efforts. She argued that such a shift would reduce tax revenue, stifle industry investment and cost jobs, including at ancillary businesses.
FAIR BET Act awaits House floor action
Titus introduced the FAIR BET Act, H.R. 4304, on July 7, 2025. The legislation passed the House Ways and Means Committee by a 38-5 vote in September and is awaiting House leadership action to bring it to a floor vote.
Her letter urges leadership to move the deduction fix to the House floor and include it in a must-pass legislative vehicle as Congress returns from recess and takes up end-of-year legislation.
