A federal judge in Boston said he needs to study three mobile gaming patents before deciding whether to dismiss part of a patent infringement case brought against DraftKings.
Cantor Fitzgerald unit InterActive Games sued DraftKings in April, alleging infringement of five patents. According to the source report, DraftKings has asked the court to throw out part of that suit, but the judge has not yet ruled.
Judge says patent review must come first
The case is in the US District Court for the District of Massachusetts. Judge William G. Young said he needs to review the three patents at issue in DraftKings’ motion before deciding the request.
The report does not say which specific claims or portions of the lawsuit DraftKings wants dismissed.
Cantor unit alleges infringement of five patents
InterActive Games’ broader complaint against DraftKings covers five patents tied to mobile gaming, according to the report. One of those patents lists Howard Lutnick, the former Cantor CEO and current head of the US Commerce Department, as an inventor.
For now, the immediate next step is the judge’s review of the patents before any ruling on the partial dismissal request.
